The worst year in Washington? The tea party

The Gadsden flag, which flew proudly over the 2010 midterm elections, now lies in tatters ? rent by internal disagreements, losses among its most visible standard-bearers and a growing sense that the tea party movement, which once looked like it could transform American politics, will soon be nothing more than a blip in the country?s collective memory.

The movement?s journey from boom to bust is the story of American politics writ large. The tea party?s ups and downs (in 2012, mostly downs) highlight some of the key forces shaping today?s battles ? from the fissures that threaten to destroy the Republican Party to the perils of a leaderless or multi-leader effort to the difference between proving a point and winning.

No one person more embodies the fruitful-turned-fractious relationship that the tea party has enjoyed with the political world (and itself) than the man whom the movement made speaker of the House after the 2010 elections: John Boehner.

Fueled by the grass-roots energy and, in some places, anger of tea party members, Republicans gained more than five dozen House seats in 2010, a sweep that put Boehner ? an institutionalist?s institutionalist ? at the top of a GOP he didn?t really recognize anymore.

For the first two years, Boehner was a SINO (Speaker in Name Only) as he regularly saw his legislative and political goals upended by the purists in his party who regarded compromise as capitulation. The debt-ceiling fight of 2011 was a sign of things to come for Boehner. The speaker engaged in long and serious talks with President Barack Obama aimed at not simply raising the country?s debt limit but also addressing our long-term budget problems. But as it became clear that Boehner was going to have to give to get, the tea party crowd in the House, who saw the debt ceiling vote as a chance to tie the government?s purse strings, made clear that they wouldn?t be going along to get along.

Then came the 2012 elections, a rebuke of the tea party?s ideas and leaders. Sensing an opportunity to wrest control of his party, or at least the House GOP, back from the fringe, Boehner went on offense. He kicked Reps. Tim Huelskamp (Kan.), Justin Amash (Mich.) and Dave Schweikert (Ariz.) off plum committees after the election, insisting that they had been insufficiently loyal to the party leadership on key votes ? the most notable of which was on the budget proposal put forward by Rep. Paul Ryan (Wis.), the vice-presidential nominee.

Stories of Boehner?s re-emergence were crafted, citing his renewed power over his Republican colleagues and using the tea party committee purge as example No. 1. Emboldened by his newfound strength, Boehner set out to show some force in his negotiations with Obama over the ?fiscal cliff.? He introduced ?Plan B,? a bill that would preserve the George W. Bush-era tax cuts on everyone except those making $1 million or more a year, and he held a 51-second news conference pledging that it would pass the House and daring the president to ignore it.

Twenty-four hours later, Boehner released a statement admitting defeat. Plan B never made it to the House floor. The speaker and Majority Leader Eric Cantor, of Virginia, couldn?t come close to securing the votes required.

The defeat was spurred by the tea party, which saw Boehner?s plan not as a way to put political pressure on the president but as an unnecessary sacrifice of a core principle. That principle? It?s never OK to raise taxes on anyone. As Boehner?s strategy sunk, and with it, his power as speaker, it was the lawmakers he had punished who celebrated most heartily.

?Republican leadership thought they could silence conservatives when they kicked us off our Committees,? Huelskamp said in a statement after Plan B?s demise. ?I?m glad that enough of my colleagues refused to back down from the threats and intimidation, thus preventing the Conference from abandoning our principles.?

Huelskamp?s victory, of course, was Pyrrhic. With Boehner marginalized, Obama and Senate Majority Leader Harry Reid, of Nevada, have been left to sort out a fiscal cliff deal ? one that almost certainly will be worse for Republicans than what Boehner proposed.

It wasn?t just in legislative battles where the tea party proved a point but lost the fight in 2012.

Indiana?s Senate race showed the promise and peril of the movement. Sen. Dick Lugar, who was first elected in 1976 and had been easily re-elected since then, faced a primary challenge from his ideological right from state Treasurer Richard Mourdock, a little-known but decidedly more tea-party-friendly candidate.

Lugar?s problems weren?t solely ideological ? he didn?t live in the state, rarely visited it and ignored advice from national party strategists to take Mourdock?s challenge seriously. But the sense that he tended toward moderation and, gasp, occasionally supported Obama on matters of foreign policy, didn?t sit well with the GOP primary electorate.

Mourdock summed up his view of government succinctly the day after he beat Lugar. ?I don?t think there?s going to be a lot of successful compromise,? he said on CNN. ?I hope to build a conservative majority in the U.S. Senate so bipartisanship becomes Democrats joining Republicans to roll back the size of government.?

He never got a chance to see that vision realized, because of a bit of political hara-kiri he committed in a late-October debate with Democratic Rep. Joe Donnelly. Asked about abortion, Mourdock paused, then said that ?even when life begins in that horrible situation of rape, that is something that God intended to happen.?

Days later, Mitt Romney carried the Hoosier State by 10 points, but Mourdock lost to Donnelly by six points ? a defeat that establishment Republicans immediately used to argue that the tea party?s political compass was either badly miscalibrated or nonexistent.

Mourdock?s win-then-loss epitomized the tea party?s steep decline, but he was far from the only GOP candidate who sacrificed victory at the altar of ideology. Rep. Allen West, running in a swing district in Florida, spent time speculating about how many communists there might be in Congress. (Eighty-one, in case you were wondering.) When asked about his feelings on abortion, Rep. Joe Walsh, running in a Democratic-leaning, suburban Chicago district, insisted that ?there is no such exception as life of the mother.? (He lost by nine points.) And a tea party heroine and former presidential hopeful, Rep. Michele Bachmann (Minn.), was re-elected by just over 4,000 votes against an unheralded Democratic challenger in a suburban Twin Cities district that leans heavily Republican.

The tea party didn?t catch a single break in Election 2012. Take Missouri, where the defeat of Todd ?legitimate rape? Akin in the Senate race was laid at the feet of the tea party. The problem with that theory? The major tea party groups had backed Akin?s primary opponents; he won on the strength of his support among social conservatives.

Beset by challenges on all sides, the tea party needed a leader. Instead, in early September, it got an attempted armed coup ? a truth-is-stranger-than-fiction scenario in which former Texas congressman Richard Armey tried to seize control of FreedomWorks, a pillar of the movement. (Armey brought an aide with a handgun holstered at his hip to the FreedomWorks headquarters as he attempted to take over. And no, that is not a joke.)

Armey?s mission came up short ? he took $8 million to part ways with the organization (not a bad consolation prize) ? but that it happened at all exposed the tea party?s fractures to a wide audience.

At the heart of the schism was the question of whether this outsider movement should acclimate itself to the establishment it rebelled against a few years ago. Could the tea party come in from the cold and enjoy the warm embrace of acceptance, or at least tolerance, from the mainstream GOP? And if not, how could it survive without national leaders to help it become something more than an insurgent effort? In other words, the tea party needed a second act but had no director. And no one could even agree on what the script should be. The result? Chaos.

If the tea party was the bright, shiny object that the political world gazed at in amazement in 2010, by 2012 it looked like a toy that had been discarded as a child moved on to bigger and better things.

To be clear: All wasn?t ? and isn?t ? lost for the tea party. While 2012 was far from its best year, the movement again proved its ability to influence Republican primary fights. Can you imagine Herman Cain as a relevant force in the presidential race without the power of the tea party?

And yet, its success also showed its limitations in 2012. Mourdock won?t be in the Senate next year. Nor Allen West in the House. A movement can become something bigger only if it understands the difference between winning a battle and winning a war ? or between a moral victory and an actual one. The tea party won a few of the former in 2012 but almost none of the latter.

For failing even when it seemed to succeed, the tea party had the worst year in Washington. Congrats, or something.

Black Monday is expected to bring plenty of darkness around the NFL, with as many as 10 coaches and many of their general manager bosses bracing for the worst on New Year's Eve. Andy Reid's sunken season in Philadelphia made him a virtual lock to be the biggest name on the unemployment line. Reid, hired by the Eagles in 1999, was the longest-tenured coach in the NFL, a mantel that transfers to Bill Belichick in New England when Reid is officially let go. Owner Jeffrey Lurie, who invested tens of millions in free agency since the start of 2010 to assemble what former backup quarterback Vince Young infamously dubbed the "Dream Team" said an 8-8 record that matched the Eagles' 2011 mark wouldn't be good enough for Reid to retain his job. The Eagles went to the postseason nine times under Reid, including six NFC East championships but only a 1-3 record in the NFC Championship game. It's possible Reid could quickly land on his feet. The native Californian could make sense if the Oakland Raiders or San Diego Chargers make a change. The Cleveland Browns, Buffalo Bills, Chargers and Kansas City Chiefs were among the franchises most likely to begin 2013 with a search for their next coach and personnel boss. Pat Shurmur, 9-22 in two seasons with the Browns, and general manager Tom Heckert were already aware of their fate Saturday. The Bills went 6-10 in 2011 and 5-10 before Sunday's game against the Jets on Gailey's watch. Kansas City had the NFL's worst record for most of the 2012 season. General manager Gene Smith is expected to be the fallguy in Jacksonville.

Texas rallies late to beat Oregon State in Alamo Bowl

SAN ANTONIO ? Texas offensive guard Mason Walters said he didn't see David Ash's momentum-turning escape and touchdown throw to Johnathan Gray ? "I had my hands full at the time trying to keep a couple more from getting after him" ? but that didn't stop him from sensing the play's impact.

"I did catch it on the Jumbotron afterwards," Walters said. "It was impressive and I don't know how he did it.

"It was huge. I've said it all year: college football is really just a game of momentum. And when you have it, you have it. When you don't, it's tough to get back."

That play, a 15-yard scoring pass with 8:18 left to go in the fourth quarter, cut the Oregon State lead to 27-24. But more importantly, it saturated the No. 23 Longhorns with enough momentum to close out a 31-27 Valero Alamo Bowl victory.

"We challenged all of our players to make sure that our seniors left happy and had a happy dressing room," Texas coach Mack Brown said. "And that's happening in there tonight."

Through three quarters, No. 13 Oregon State built a 27-17 lead by running the ball and keeping the Texas offense off balance. Texas entered the fourth quarter with 201 total yards, and Ash was just 12 of 22 for 95 yards with an interception. But in the final 15 minutes, Ash caught fire, completing 9-of-11 passes for 146 yards, and hitting on his last seven passes as Texas scored on its final two drives to pull out the comeback victory.

"You just kind of keep plugging away and you kind of wait for that play that sparks," Ash said. "This game, we started getting them, and we got the momentum back and we started playing well."

Texas's Major Applewhite faced a challenge in his first game as offensive coordinator and primary play-caller. First, he had just two weeks to game plan and make any necessary adjustments. Second, he faced a stingy Oregon State defense that excels at stuffing runs between the tackles ? exactly what Texas wanted to accomplish offensively. And third, Applewhite's backup quarterback, Case McCoy, was suspended for violation of team rules on Friday prior to the game.

"I'd like to forget that," Applewhite said of facing a difficult backup situation. "I spent about two hours with (true freshman) Jalen Overstreet in Conference Ballroom 15 trying to get ready for the game, and it was a little nerve-wracking."

Applewhite said that because of the quarterback situation, Texas was hesitant to run Ash too early and leave him susceptible to injury. But in the third quarter, with Texas trailing 20-10, and with no running game to speak of, the Longhorns called two designed quarterback draws in three plays. The first, called on a third-and-4, picked up 5 yards and a first down. On the second, Ash rushed for an 11-yard touchdown, leaping over an Oregon State defender into the end zone and providing that first spark.

"David really gained a lot of confidence, especially on the one where he ran it in and jumped over a guy in the end zone," said Texas wide receiver Jaxon Shipley. "You could see it. You could feel it. Everybody was fired up, especially him. From that point on, I felt like he definitely had a feeling that we were going to win the game."

Applewhite was also helped by a monster game from Alamo Bowl Offensive MVP Marquise Goodwin. Early in the second quarter with the Longhorns stymied offensively, Goodwin took a reverse 64 yards for a touchdown. And the speedster who competed in this past summer's London Olympics as a long-jumper burst past his defender to haul in the game-winning, 36-yard touchdown pass with 2:24 left.

"When you get those guys that have exceptional speed, they can do things outside of the design of the play so you don't have to be perfect, there's a little bit more margin for error," Applewhite said.

But Goodwin's speed wasn't the only speed that had a major effect on the game. The Longhorn offense went up-tempo through the second half and wore down the Beavers late.

"We probably were on the field too much . . ." said Oregon State coach Mike Riley. "We didn't sustain enough, didn't get enough first downs to give our defense a chance."

That was the result of a freshly dialed-in Texas defense, which gave up 228 yards and 20 points in the first half. Beavers running back Storm Woods ? in a homecoming of sorts ? rushed for 98 yards on 15 carries and a touchdown. In all, the Pflugerville native combined with fellow running back Terron Ward and receivers Markus Wheaton and Brandin Cooks to gash the Longhorns for 151 yards in the first half.

"The first half, we felt like we played great sound football," Woods said. "And the second half felt like Texas just made some adjustments and they came out and they just?. . .?I guess they wanted it more or something."

Texas defensive coordinator Manny Diaz said afterward that the Texas defense had a decision to make at halftime.

"To me, it was whether they wanted to fight their way out of it or sort of accept their fate," Diaz said. "I'm so proud of the way that they fought, the way that they battled in the second half."

Buoyed by the tremendous pass rush from Defensive MVP Alex Okafor, Texas rattled junior Cody Vaz and shut down the running lanes that were so easily accessible in the first half. Vaz entered the game with an 11-to-1 touchdown-to-interception ratio, but he finished 15 of 28 for 194 yards and no touchdowns to two picks. More impressively, he was sacked 10 times, with Okafor's Alamo Bowl-record 4.5 sacks providing the primary damage. Woods ran six times for 20 yards in the second half, as the Beavers had just 69 total second-half yards.

And when it came down to the end, after the Longhorns took the lead, the defense closed things out. On third-and-8, Okafor made the last of his sacks in bullying his way to tackle Vaz. And on fourth-and-14, linebacker Kendall Thompson pulled Vaz to the turf to end any hope of a Beaver rally.

"It's always great to end the season on a good note," said Okafor, who ended his senior season with 12.5 sacks. "We're going to use this game as a stepping stone, and Coach Diaz just talked about that we have to demand more from ourselves. That was kind of the mindset going into this game, and that's what we did."

For the second consecutive year, Texas ended with a victory, and the Longhorns finished 9-4. Oregon State, which entered the postseason with a 9-3 mark, finished with an identical record.

Walters said that momentum gained from that play, and the ensuing win, could also be applied on a more macro scale. The Longhorns won at least 10 games per season in Brown's first 12 seasons, but have failed to hit that standard in the three seasons since. Now, Texas is looking to morph the season-ending victory into a strong offseason and, eventually, a comeback of another kind ? the restoration of the Texas program as a whole.

"That's big. We experienced it last year and obviously?. . .?if you look at it at the end of the year, and we judge wins and losses, we've improved from where we were last year.

"However, this is not where we want to end up," Walters said. "This isn't going to be good enough. I wouldn't accept 9-4 next year. I wouldn't take that deal right now. We're just going to have to ride it. I know I've already talked to a lot of guys that are going to be on the team next year, we're excited to get back to work and get back together with everybody and get back on the grind."

peace bonds under s. 810 of the criminal code: should you consent?

I'm currently assisting a number of clients with "peace bond" problems. These are orders under s. 810 of the Criminal Code that can subject you to "keep the peace and be of good behaviour for any period that does not exceed twelve months, ?and comply with such other reasonable conditions prescribed in the recognizance" such as prohibiting you from being at or within a specific distance of a place, or prohibiting you from communicating directly or indirectly with a particular person.?

A justice of the peace (or judge) can impose a peace bond on you when a person demonstrates that he or she has reasonable grounds to fear that you "will cause personal injury to him or her or to his or her spouse or common-law partner or child or will damage his or her property." A mini-trial is actually held by the court to determine if the peace bond should be imposed - that's why you really need legal counsel to defend you if you receive a notice that someone is seeking a peace bond against you.?

Being subject to a peace bond is a lot like being on bail.?Peace bonds make conduct illegal that was previously perfectly legal. Like sending an e-mail or text to someone. Or attending at that person's place of work or home.?

Breach of the peace bond can lead to serious criminal consequences.?There's some debate among Canadian criminal lawyers over exactly which punishment provisions apply to peace bond breach, as s. 810 of the Criminal Code doesn't itself stipulate any specific punishments, but up to 2 years imprisonment seems a definite possibility for peace bond breach pursuant to s. 127 of the Criminal Code, which is a catch-all punishment provision for disobeying a court order.?

Refusing to enter into the peace bond recognizance, after it has been ordered by the court, can also get you up to 12 months in jail.?

The fact you have been ordered to enter into a peace bond (even if you consented) also winds up on police databases, potentially for the rest of your life. No, it's not a "criminal record," but it does at times convey the impression that you were up to no good, and thus the peace bond was ordered to protect someone from you.?

Pace bonds are serious business, so you need to know when you should and should not be thinking of voluntarily entering into them.?

When voluntarily entering into a peace bond can be a good idea: if you are being prosecuted for criminal offences under the Criminal Code, and instead of the Crown proceeding with the prosecution you are offered the alternative of voluntarily entering into a peace bond, such an offer is usually a good deal that you should jump at.?

Do get some legal advice before consenting in such a situation. Even if you are representing yourself on the charges to which the peace bond is an alternative, "duty counsel" at the court house may be able to give you some summary advice. Here the peace bond is way better than being convicted of a criminal offence after trial, and also way better than receiving an absolute or conditional discharge as a sentence.?

When voluntarily entering into a peace bond can be a bad idea: if you aren't facing any kind of criminal charges, and instead have a peace bond application dropped on you by your neighbour/ co-worker/ family member. In these cases, there has been no government filter (like the police or prosecution service) involved in deciding whether a peace bond application should proceed. Instead, this is essentially a private prosecution which might have no basis in reality whatsoever, and where you can essentially be found guilty on a balance of probabilities standard, not on a proof beyond a reasonable doubt standard.?

If you aren't facing other court proceedings that will be halted by a peace bond, you shouldn't consent to it just to avoid the hassle of a court hearing on the bond. The whole peace bond hearing will probably only take somewhere between 1/2 a day and a day in court, you will get to agree on the hearing date set for several months in the future, and most importantly you are entitled to written disclosure of the factual allegations which supposedly support the peace bond. Obtaining disclosure gives you a chance of preparing a defence to the allegations through gathering together your own evidence to present to the court - including the calling of your own witnesses who can explain why the allegations just aren't true.?

The moral of this story is that peace bonds are tricky?contradictory?creatures, part of the criminal process, but granted on a civil standard of proof, heard in the criminal courts, but usually pursued by a private individual rather than a government prosecutor. Some people steadfastly refuse to consent to peace bonds even when it is in their best interests to consent, and other people readily consent even though it is unlikely any court would grant peace bonds against them because of the shoddy evidentiary foundations upon which the peace bond allegations are based. The first type of overly refusing people should take more seriously the advice their lawyers are trying to give them; the second type of overly consenting people should seek out legal advice before agreeing to something that could have a significant future impact on their lives.?

U.S. Education Dept. Offers Tools for Evaluating Ed. Tech. - Digital ...

Education technology, to state the obvious, is everywhere. But how can school officials judge the effectiveness of the myriad tools and products being marketed to them, and their usefulness in terms of meeting the particular needs of teachers and students?

The U.S. Department of Education's Office of Educational Technology has released a draft report, "Expanding Evidence Approaches for Learning in a Digital World," designed to offer the education community some guidance for navigating the crowded tech landscape.

The report is meant to provide approaches for school officials and others seeking to gather evidence on digital learning systems, guidance that can be adapted to the needs of individual schools and districts. The document draws from the perspectives of education researchers, school technology developers, and educators themselves.

The report was released earlier this month in draft form for public comment, Karen Cator, the director of the office of educational technology, explained in an e-mail. Cator also discussed the goals of the document in a recent online blog post.

The document includes a "framework" meant to help educators and others evaluate the uses of education technology. One of the goals of the framework is to give school officials "greater confidence that investments in cost-effective and cost-saving technology-based interventions are wise, capable producing the outcomes sought," the report says.

That framework includes an evidence "reference guide," which focuses primarily on six approaches for using evidence to evaluate school technology, as well as other approaches commmonly used in education. It presents readers with an evidence "decision-making model," that can be used to gather evidence on digital learning resources, once they have been selected, so that they can be implemented effectively.

And it offers scenarios describing how various evidence standards might be used in hypothetical situations?for a superintendent trying to choose a technology-based math curriculum aligned with the Common Core State Standards, for instance, or a mother attempting to research the most appropriate online games, apps, and websites to help her soon improve his vocabulary.

"The need for expanded approaches to evidence that take advantage of and solve challenges created by digital learning resources is not new," the authors say. "What is new is the increased number and sophistication of digital learning resources and the vast amounts of data those systems generate while in use."

Schools are operating amid a "rapid rate of consumer adoption of these resources," the report continues. "These developments provide the opportunity to ask and answer these essential questions: What is appropriate evidence under which circumstances? How do we obtain it? How do we use it?"

The approaches for using evidence described in the report are also meant to address five overriding challenges in digital education, the authors say: ensuring that tech resources promote deep learning; creating "adaptive learning systems" that allow for personalized approaches for different students; combining and analyzing data from different sources to provide more targeted help for students; improving assessment through technology; and helping educators make informed choices about digital resources.

HTC HD2 runs Windows RT, postpones trip to afterlife yet again

HTC's HD2 may have begun life as just another Windows Mobile 6.5 handset, but its surprisingly hardy internals enable it to run almost any mobile OS going. The latest software to appear on the three-year-old device is Windows RT, which was jammed onto the system by a developer called Cotulla -- who previously put Windows Phone 7 on the same unit. While we imagine it's not that comfortable to use on the HD2's 4.3-inch screen, we can imagine some superheroes are now scouring eBay for a similarly immortal smartphone.

Egypt's Mubarak to stay in army hospital as health worsens

CAIRO (Reuters) - Egypt's deposed leader Hosni Mubarak, who is serving a life sentence for his role in killing protesters during a 2011 revolt, will stay in an army hospital for at least two weeks after his health deteriorated, his lawyer said on Friday.

The state of Mubarak's already fragile health has been the subject of intense speculation in Egypt and he has spent much of the time before and after his trial in various hospitals.

On Thursday evening, the 84-year-old former leader was transferred to an army hospital from his prison clinic after fracturing a rib in a recent fall.

"He will stay in the hospital for about 15 days," Mohamed Abdel Razek, his lawyer, told Reuters.

"The president's health is stable, thank God. He underwent X-rays on his body and now he will get proper treatment in the hospital for all his bone problems he has been suffering from."

Mubarak was toppled after 30 years in power and sentenced to life in prison in June this year. He was admitted to a prison hospital that same month following what security officials described at the time as a "health crisis".

During his trial, Mubarak, the first Arab ruler to be brought to court by his own people, was routinely wheeled into the cage used for defendants in Egyptian courts on a hospital gurney.

He has not spoken publicly about the events that followed his downfall, saying almost nothing at his trial appearances beyond confirming his presence and denying the charges against him.

Mubarak's legal team had been pressing to have him moved from the prison hospital to a better-equipped facility permanently, saying he was not receiving adequate treatment.

But there has been some confusion over the exact nature of his ailments, with state media reporting a variety of illnesses ranging from shortage of breath to heart attacks and comas.

Google Maps iPhone App Downloaded 58 Times Per Second

Google Maps For iPhone IconGoogle's Jeff Huber announced on Google+ that Google's new iPhone Google Maps app was downloaded over 10 million times in 48 hours.

That means it was downloaded about 58 times per second or 3,500 times per minute over the course of two days.

The app has over 20,000 reviews with almost a perfect 5 star rating. I think Google can call this launch a success. If only it was released earlier when iOS 6 came out.

(AP) ? After leading his conservative party to a landslide victory that will bring it back to power after a three-year hiatus, Shinzo Abe stressed Monday that the road ahead will not be easy as he tries to revive Japan's sputtering economy and bolster its national security amid deteriorating relations with China.

The Liberal Democratic Party, which led Japan for most of the post-World War II era until it was dumped as the economy fizzled in 2009, won 294 seats in the 480-seat lower house of parliament in Sunday's nationwide elections, according to media reports. Official results were expected later Monday.

With the elections over, a vote among the members of parliament to install the new prime minister is expected as soon as Dec. 25. Abe, who was prime minister from 2006-2007, is almost certain of winning that vote because the LDP now holds the majority in the lower house.

"We won more seats than even we expected," Abe, 58, said Monday. "We have a very heavy responsibility."

Outgoing Prime Minister Yoshihiko Noda announced his resignation late Sunday, calling the election results "severe" and acknowledging his party failed to live up to the nation's high expectations.

His Democratic Party of Japan reportedly won only 57 seats. Among its casualties were eight Cabinet ministers ? the most lost in an election since World War II.

Economic issues, including plans to raise taxes and other measures to bolster Japan's underperforming economy, were the top concerns among voters.

Abe, who would be Japan's seventh prime minister in 6 1/2 years, will likely push for increased public works spending and lobby for stronger moves by the central bank to break Japan out of its deflationary trap.

Stock prices soared Monday morning to their highest level in more than eight months, reflecting hopes in the business world that the LDP will be more effective in its economic policies than the Democrats were.

Although the election was the first since the March 11, 2011, earthquake, tsunami and nuclear disasters, atomic energy ? which the LDP conditionally supports ? ended up being a side issue, though polls showed that about 80 percent of Japanese want to phase it out completely.

Instead, Abe and his party stressed national security amid an ongoing dispute with China over a group of small uninhabited islands that both nations claim.

That kind of tough talk resonates with some voters who fear their country is falling too far behind China's rising economic and military clout, but it could also deepen a rift between Tokyo and Beijing that has already begun to sour diplomatic ties and trade.

Abe is known as a hawk on China relations ? which could mean more friction with Japan's giant neighbor and key trading partner.

During his previous tenure as prime minister, Abe pursued a nationalistic agenda, pressing for more patriotic education and upgrading the defense agency to ministry status. The LDP wants to revise Japan's pacifist constitution to strengthen its Self-Defense Forces and, breaching a postwar taboo, designate them as a "military."

It also proposes increasing Japan's defense budget and allowing Japanese troops to engage in "collective self-defense" operations with allies that are not directly related to Japan's own defense.

But with the economy in more dire straits, it remains to be seen how Abe will behave this time around.

As the results came in Sunday night, he acknowledged that the outcome of the elections was as much ? if not more ? of a protest against the status quo as it was an endorsement of his party's platform.

The LDP will stick with its longtime partner New Komeito, backed by a large Buddhist organization, to form a coalition government, party officials said. Together, they now control 325 seats, securing a two-thirds majority that would make it easier for the government to pass legislation.

A dizzying array of more than 12 parties, including several news ones, contested, some with vague policy goals. The most significant new force is the right-leaning, populist Japan Restoration Party, which won 54 seats, according to NHK.

The party is led by the bombastic nationalist former Tokyo Gov. Shintaro Ishihara and lawyer-turned Osaka Mayor Toru Hashimoto ? polarizing figures with forceful leadership styles. Ishihara is another hawk on China, having stirred up the latest dispute with Beijing by proposing Tokyo buy the islands from their private Japanese owners and develop them.

The anti-nuclear Tomorrow Party ? formed just three weeks ago ? captured only nine seats, according to NHK. Party head Yukiko Kada said she was very disappointed to see the LDP, the original promoter of Japan's nuclear energy policy, make such a big comeback.

Video Tour of the International Space Station

But watching this video reminded me of the good that's come out of it: There is science being done there; we're learning how to design and build hardware for long-term space travel; we're learning just how to live in space (and NASA just announced it will be sending humans into space for an entire year, an unprecedented experiment); and we're finding new ways for nations and individuals to cooperate in space."

'Always smiling': Portraits of Connecticut victims

Most died at the very start of their young lives, tiny victims taken in a way not fit for anyone regardless of age. Others found their life's work in sheltering little ones, teaching them, caring for them, treating them as their own. After the gunfire ended Friday at Sandy Hook Elementary School, the trail of loss was more than many could bear: 20 children and six adults at the school, the gunman's mother at home, and the gunman himself.

A glimpse of some of those who died:

Charlotte Bacon, 6, student

They were supposed to be for the holidays, but finally on Friday, after much begging, Charlotte Bacon's mother relented and let her wear the new pink dress and boots to school.

It was the last outfit the outgoing redhead would ever pick out. Charlotte's older brother, Guy, was also in the school but was not shot.

Her parents, JoAnn and Joel, had lived in Newtown for four or five years, JoAnn's brother John Hagen, of Nisswa, Minn., told Newsday.

"She was going to go some places in this world," Hagen told the newspaper. "This little girl could light up the room for anyone."

Olivia Engel, 6, student

The images of Olivia Engel will live far beyond her short lifetime. There she is, visiting with Santa Claus, or feasting on a slice of birthday cake. There's the one of her swinging a pink baseball bat, and another posing on a boat. In some, she models a pretty white dress; in others, she makes a silly face.

Dan Merton, a longtime friend of the girl's family, says he could never forget the child, and he has much to say when he thinks of her.

"She loved attention," he said. "She had perfect manners, perfect table manners. She was the teacher's pet, the line leader."

On Friday, Merton said, she was simply excited to go to school and then return home and make a gingerbread house.

"Her only crime," he said, "is being a wiggly, smiley 6-year-old."

Dawn Hochsprung, 47, principal

Dawn Hochsprung's pride in Sandy Hook Elementary was clear. She regularly tweeted photos from her time as principal there, giving indelible glimpses of life at a place now known for tragedy. Just this week, it was an image of fourth-graders rehearsing for their winter concert; days before that, the tiny hands of kindergartners exchanging play money at their makeshift grocery store.

She viewed her school as a model, telling The Newtown Bee in 2010 that "I don't think you could find a more positive place to bring students to every day." She had worked to make Sandy Hook a place of safety, too, and in October, the 47-year-old Hochsprung shared a picture of the school's evacuation drill with the message "safety first." When the unthinkable came, she was ready to defend.

Officials said she died while lunging at the gunman in an attempt to overtake him.

"She had an extremely likable style about her," said Gerald Stomski, first selectman of Woodbury, where Hochsprung lived and had taught. "She was an extremely charismatic principal while she was here."

Madeleine Hsu, 6, student

Dr. Matthew Velsmid was at Madeleine's house on Saturday, tending to her stricken family. He said the family did not want to comment.

Velsmid said that after hearing of the shooting, he went to the triage area to provide medical assistance but there were no injuries to treat.

"We were waiting for casualties to come out, and there was nothing. There was no need, unfortunately," he said. "This is the darkest thing I've ever walked into, by far."

Velsmid's daughter, who attends another school, lost three of her friends.

Catherine Hubbard, 6, student

A family friend turned reporters away from the house, but Catherine's parents released a statement expressing gratitude to emergency responders and for the support of the community.

"We are greatly saddened by the loss of our beautiful daughter, Catherine Violet and our thoughts and prayers are with the other families who have been affected by this tragedy," Jennifer and Matthew Hubbard said. "We ask that you continue to pray for us and the other families who have experienced loss in this tragedy."

Chase Kowalski, 7, student

Chase Kowalski was always outside, playing in the backyard, riding his bicycle. Just last week, he was visiting neighbor Kevin Grimes, telling him about completing ? and winning ? his first mini-triathlon.

"You couldn't think of a better child," Grimes said.

Grimes' own five children all attended Sandy Hook, too. Cars lined up outside the Kowalskis' ranch home Saturday, and a state trooper's car idled in the driveway. Grimes spoke of the boy only in the present tense.

Nancy Lanza, 52, gunman's mother

She once was known simply for the game nights she hosted and the holiday decorations she put up at her house. Now Nancy Lanza is known as her son's first victim.

Authorities say her 20-year-old son Adam gunned her down before killing 26 others at Sandy Hook. The two shared a home in a well-to-do Newtown neighborhood, but details were slow to emerge of who she was and what might have led her son to carry out such horror.

Kingston, N.H., Police Chief Donald Briggs Jr. said Nancy Lanza once lived in the community and was a kind, considerate and loving person. The former stockbroker at John Hancock in Boston was well-respected, Briggs said.

Court records show Lanza and her ex-husband, Peter Lanza, filed for divorce in 2008. He lives in Stamford and is a tax director at General Electric. A neighbor, Rhonda Cullens, said she knew Nancy Lanza from get-togethers she had hosted to play Bunco, a dice game. She said her neighbor had enjoyed gardening.

"She was a very nice lady," Cullens said. "She was just like all the rest of us in the neighborhood, just a regular person."

Jesse Lewis, 6, student

Six-year-old Jesse Lewis had hot chocolate with his favorite breakfast sandwich ? sausage, egg and cheese ? at the neighborhood deli before going to school Friday morning.

Jesse and his parents were regulars at the Misty Vale Deli in Sandy Hook, Conn., owner Angel Salazar told The Wall Street Journal.

"He was always friendly; he always liked to talk," Salazar said.

Jesse's family has a collection of animals he enjoyed playing with, and he was learning to ride horseback.

Family friend Barbara McSperrin told the Journal that Jesse was "a typical 6-year-old little boy, full of life."

Ana Marquez-Greene, 6, student

A year ago, 6-year-old Ana Marquez-Greene was reveling in holiday celebrations with her extended family on her first trip to Puerto Rico. This year will be heartbreakingly different.

The girl's grandmother, Elba Marquez, said the family moved to Connecticut just two months ago, drawn from Canada, in part, by Sandy Hook's sterling reputation. The grandmother's brother, Jorge Marquez, is mayor of a Puerto Rican town and said the child's 9-year-old brother also was at the school but escaped safely.

Elba Marquez had just visited the new home over Thanksgiving and is perplexed by what happened. "What happened does not match up with the place where they live," she said.

A video spreading across the Internet shows a confident Ana hitting every note as she sings "Come, Thou Almighty King." She flashes a big grin and waves to the camera when she's done.

Jorge Marquez confirmed the girl's father is saxophonist Jimmy Greene, who wrote on Facebook that he was trying to "work through this nightmare."

"As much as she's needed here and missed by her mother, brother and me, Ana beat us all to paradise," he wrote. "I love you sweetie girl."

James Mattioli, 6, student

The upstate New York town of Sherrill is thinking of Cindy Mattioli, who grew up there and lost her son James in the school shooting in Connecticut.

"It's a terrible tragedy, and we're a tight community," Mayor William Vineall told the Utica Observer-Dispatch. "Everybody will be there for them, and our thoughts and prayers are there for them."

James' grandparents, Jack and Kathy Radley, still live in the city, the newspaper reported.

Anne Marie Murphy, 52, teacher

A happy soul. A good mother, wife and daughter. Artistic, fun-loving, witty and hardworking.

Remembering their daughter, Anne Marie Murphy, her parents had no shortage of adjectives to offer Newsday. When news of the shooting broke, Hugh and Alice McGowan waited for word of their daughter as hours ticked by. And then it came.

Authorities told the couple their daughter was a hero who helped shield some of her students from the rain of bullets. As the grim news arrived, the victim's mother reached for her rosary.

Quick to cheer up those in need of a smile, Emilie Parker never missed a chance to draw a picture or make a card.

Her father, Robbie Parker, fought back tears as he described the beautiful, blond, always-smiling girl who loved to try new things, except foods.

Parker, one of the first parents to publicly talk about his loss, expressed no animosity for the gunman, even as he struggled to explain the death to his other two children, ages 3 and 4. He's sustained by the fact that the world is better for having had Emilie in it.

"I'm so blessed to be her dad," he said.

Noah Pozner, 6, student

The way Noah Pozner's parents saw it, no schools in New York could compare with those in Newtown, a relative told Newsday. So they moved their family ? Noah, his twin sister and his 8-year-old sister.

"At this stage, two out of three survived. ... That's sad," said Noah's uncle Arthur Pozner, of New York City's Brooklyn borough. "The reason they moved to that area is because they did not consider any school in New York state on the same level. That's one of the reasons they moved, for safety and education."

Noah's siblings were also students there but were not hurt. Noah's uncle recalled him as "extremely mature."

"When I was his age, I was not like him," Pozner told the newspaper. "Very well brought up. Extremely bright. Extremely bright."

Lauren Gabrielle Rousseau, 30, teacher

Lauren Rousseau had spent years working as a substitute teacher and doing other jobs. So she was thrilled when she finally realized her goal this fall to become a full-time teacher at Sandy Hook.

Her mother, Teresa Rousseau, a copy editor at the Danbury News-Times, released a statement Saturday that said state police told them just after midnight that she was among the victims.

"Lauren wanted to be a teacher from before she even went to kindergarten," she said. "We will miss her terribly and will take comfort knowing that she had achieved that dream."

Her mother said she was thrilled to get the job.

"It was the best year of her life," she told the newspaper.

Rousseau has been called gentle, spirited and active. She had planned to see "The Hobbit" with her boyfriend Friday and had baked cupcakes for a party they were to attend afterward. She was born in Danbury, and attended Danbury High, college at the University of Connecticut and graduate school at the University of Bridgeport.

She was a lover of music, dance and theater.

"I'm used to having people die who are older," her mother said, "not the person whose room is up over the kitchen."

Mary Sherlach, 56, school psychologist

When the shots rang out, Mary Sherlach threw herself into the danger.

Janet Robinson, the superintendent of Newtown Public Schools, said Sherlach and the school's principal ran toward the shooter. They lost their own lives, rushing toward him.

Even as Sherlach neared retirement, her job at Sandy Hook was one she loved. Those who knew her called her a wonderful neighbor, a beautiful person, a dedicated educator.

Her son-in-law, Eric Schwartz, told the South Jersey Times that Sherlach rooted on the Miami Dolphins, enjoyed visiting the Finger Lakes, relished helping children overcome their problems. She had planned to leave work early on Friday, he said, but never had the chance. In a news conference Saturday, he told reporters the loss was devastating, but that Sherlach was doing what she loved.

"Mary felt like she was doing God's work," he said, "working with the children."

Victoria Soto, 27, teacher

She beams in snapshots. Her enthusiasm and cheer was evident. She was doing, those who knew her say, what she loved.

And now, Victoria Soto is being called a hero.

Though details of the 27-year-old teacher's death remained fuzzy, her name has been invoked again and again as a portrait of selflessness and humanity among unfathomable evil. Those who knew her said they weren't surprised by reports she shielded her first-graders from danger.

"She put those children first. That's all she ever talked about," said a friend, Andrea Crowell. "She wanted to do her best for them, to teach them something new every day."

Photos of Soto show her always with a wide smile, in pictures of her at her college graduation and in mundane daily life. She looks so young, barely an adult herself. Her goal was simply to be a teacher.

"You have a teacher who cared more about her students than herself," said Mayor John Harkins of Stratford, the town Soto hailed from and where more than 300 people gathered for a memorial service Saturday night. "That speaks volumes to her character, and her commitment and dedication."
